TERMS OF SERVICE - postAprop & propHOSTING.com

Please read these terms carefully before completing your order. Your use of our website and software constitutes your acceptance of these terms and conditions.

postAprop & propHOSTING provides a website hosting service. All services provided by our website service may be used for lawful purposes only.  Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material that is threatening or obscene, material that is "adult only" content, or material protected by trade secrets and other statue. propHOSTING.com will be the sole authority as to what constitutes a violation of this provision.

postAprop & propHOSTING

All hosting of user websites, blogs, and landing pages will be with our hosting services at propHOSTING.com. After signup, users will receive an activation email from propHOSTING.com. It will include the users login information to access the website area, hosting, all designs, content, and templates. For support users can use the contact form on postAprop.com, support ticket inside propHOSTING, or the support email posted inside the propHOSTING website area.


FEES

postAprop & propHOSTING provides a website hosting service. This is a prepaid hosting service with a strict NO REFUND policy. Our service bills, in advance, according to the Payment Package selected by you at sign up. We have a monthly and annual payment plan. You can cancel at any time but there are no prorated refunds. (Please review the cancellation policy below). Cost for service: Two Payment Plans:
Monthly Plan: $39.97/month
Annual Plan: $299/year.

Payment for your website and hosting service will be made with a valid credit or via PAYPAL prior to the start of your service. If you choose the monthly plan, you hereby authorize our company to charge your credit card or PAYPAL account for such amounts on a monthly basis, generally 30 days after your initial subscription. If you choose the annual payment plan, your account will be charged for the entire period (1 year) in advance. There are no refunds or pro-rated refunds on annual or monthly plans. Please see "No Refund Policy" below. At the end of each billing period, your account will renew automatically unless you cancel. This automatic renewal applies to monthly and annual payment plans. It also includes the annual registration on any domains you have registered with us.

The FEES paid to postAprop do NOT cover any advertising costs such as Google Pay-Per-Click, Adwerx, Facebook Ads, Adroll, or any 3rd party marketing company or digital ad service. These services, and running digital ads, are not required to use postAprop. If the user opts to use these services, the user pays for them directly.

If, for some reason, we are unable to process your credit card order, we will attempt to contact you by email and we will suspend usage of your account until your payment can be processed.

We are not responsible for lost information or business loss due to a declined or expired credit card.

It is your responsibility to provide us with an email address which is not @ the domain you are signing up under. If there is ever a billing issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times.


SUBSCRIPTION

Our service provides hosting, email marketing, and an online squeeze page software.  To use this service all users must sign up for a subscription plan that has recurring billing.  Every user must agree to authorize payments based on the billing plan they choose. We have both monthly and annual payment options. By purchasing our service, you authorize us to charge your credit card or PAYPAL account at the end of each billing period. This is a prepaid service with a strict No Refund policy on both the monthly and annual plan. 

If you order the annual plan, the service will automatically renew after 1 year.  The payment amount for the renewal is posted on our site BEFORE your initial purchase.  When ordering you will see the "Total Due Today" and the "Total Recurring".   The amount listed on the row for "Total Recurring" is the amount that you authorize us to charge your after the billing period ends.  If you do not want us to charge you after the initial payment period all you need to do is cancel our service (Please see the Cancellation Policy in these Terms Of Service).

Below you will find screenshots of our Shopping Cart.  The shopping cart will clearly post the "Total Recurring" based on the plan you choose.

 

By signing up for our services, you authorize us to charge you for the Total Recurring amount UNLESS you cancel within 48 hours of the renewal.  Please see cancellation policy below.
 

CANCELLATION POLICY

You can cancel your services at any time. Cancelling our service will prevent any further billing of your account.

Account cancellations should be made 48 hours before the next billing period to avoid a charge for the upcoming billing period.  If you pay monthly this means you need to contact us 48 hours before your invoice due date.  You can find all of your invoices in your CLIENT AREA.  
 
TO CANCEL: Please do one of the following:

    1. Send cancellation requests via email to: howtoleads@gmail.com (Please include your name, domain, and email address). 
    2. Login to your CLIENT AREA and open a support ticket to request cancellation.
    3. Use the "Cancellation Request" button in your CLIENT AREA. 

Once we receive your cancellation we will confirm with you via e-mail before your account will been cancelled.   Once your service is cancelled, all website files will be deleted including database for leads.  All of your websites will be removed from our servers and hosting.  

If you are using the paypal payment method be sure to cancel your recurring payment inside your paypal account.
 

NO REFUND

We require users to prepay for our service and agree to our No Refund policy. You can cancel at any time but we do not issue any refund for the remaining days of your order. Once an order is completed we prepay for several services for your billing period, therefore, we have a strict no refund policy. The no refund policy applies to both our monthly plans, annual "unlimited plan", and all marketing plans and programs. It applies to all services including the hosting plan, landing page service, squeeze page software, SEO, marketing material, Facebook marketing services, online courses, graphics design, video creation services, "Done-For-You" page orders, and domain registration and transfers. If the buyer enters a domain name with the incorrect spelling there is no refund once the domain is registered. These are all prepaid services with no full or partial refund.

No refunds or partial refunds are granted for any reason or for any service ordered on our website.

We do NOT guarantee lead costs, costs per lead, costs per click, number of leads generated, or any results. The Pro Plan includes a landing page setup with a matching Facebook Ad. No results are guaranteed.


PRO PLAN, Ad Management Services, And Facebook Ad Setup

In 2019, we added an optional "PRO PLAN". This is an optional service to our hosting plans. It includes the creation of one marketing campaign (usually on Facebook). It may include market research, branded graphic creation for both landing pages and digital ads, Ad copy, and landing page copy on a complete lead capture funnel. The funnel usually consists of 3 parts. The home page for initial lead capture, the 2nd page is often a quiz page to ask a series of questions, and finally the "content page" that may have a link to content or property information.

Once the pro plan is ordered, our work starts by reviewing campaign options, market research, evaluating your online presence, pulling graphics, optimizing photos, and creating custom graphics and/or video. There are NO REFUNDS, once the order is placed. We do market research and create campaigns specific to your area and business. Once the order is placed, we have a strict NO REFUND policy on our Pro Plan service.

Typical turnaround on a Pro Plan may be 3-7 days. In some cases it may take longer. Delays could arise for a number of reasons including changes with online marketing platforms such as Facebook, Google, etc. If the buyer needs an update or has questions, they can open up a support ticket in the client area. We will reply and update. If the campaign is not ready within 7 days, the buyer should contact support for an update.

The Pro Plan does NOT include ad updates, ad changes, or ad monitoring. We do a checkup on the ad campaign 2-5 days after setup. After the checkup, we do not provide ongoing ad management for the one time fee of the Pro Plan.

Running ads on Facebook requires an ad budget. The Ad Budget is paid by the user and not included in any fees paid to postAprop. The Pro Plan and all of our ad management options do NOT include ad spend. With any Facebook add, Google ads, and all digital ads the user pays for these costs directly. Typical ad cost for running a Facebook Ad Campaign runs from $5/day to over $50/day. For questions about ad budget please contact us before ordering.

We do not provide any 3rd party integration. If you need an integration (such as Zapier or to your 3rd party CRM), there will be additional charges for this work. Contact support at howtoleads@gmail.com for a quote on any integration work BEFORE ordering.

Online Marketing, Facebook Ads, & Client Expectations

As stated above, we do NOT guarantee any results. There are many factors involved in converting your marketing efforts into clients. Many of these factors are out of our control such as the ability of the user (Real Estate Agent, Loan Officer, etc) to connect with their prospects. Additionally, it is a mistake to expect "SHORT TERM RESULTS". Marketing in the real estate niche should be a long term approach. The value we bring to your business with our landing pages, branded videos, and ad setup is to:
1: Build Your Brand with consistent marketing (example - Running a Facebook ad for 4-5 months)
2: Create a "custom audience" - If we create a Video Ad for you, it will create a "Custom Audience". There is GREAT value here. The audience should be used with long term marketing strategy with retargeting ads.
3: Traffic to your landing pages and websites - Facebook remains one of the most cost effective way to drive local traffic to your websites.

VERY IMPORTANT NOTE:*Do not expect our service to be a "short term marketing fix". It is a LONG TERM marketing approach of brand building, creating your custom audience, and generating traffic to your real estate landing pages.
Don't think about "results" over the next 1-2 months. Think about the impact long term. Over 6 months and more and how the 3 key benefits (brand building, custom audience, and traffic) will help your business grow.


SMS/Text Marketing

Each user can setup text responses to your leads. Instant text messages and drip (a series of messages over time). We are integrated with Twilio for text marketing. This requires a Twilio account (no monthly cost for this account) and a Twilio Phone Number ($1/month or $2/month for toll free number). Cost to send texts works out to $7-8 for 100 text messages.

Typical turnaround on a Pro Plan may be 3-7 days. In some cases it may take longer. If the buyer needs an update or has questions, they can open up a support ticket in the client area. We will reply and update.



AD MANAGEMENT
We do have addon services for ad management, Facebook marketing, and other online marketing. The starting price point is $599/month for the management of ad campaigns. This cost is in addition to your monthly or annual cost of your "Unlimited Plan" (our hosting and landing page service) and it does NOT include any ad budget. With ad management we will create, monitor and adjust your ad campaigns for you. We ask clients to expect a minimum of a 4 month commitment on any ad management plan. This is not a requirement as we bill month to month for the ad management and you can cancel at any time to stop billing. However, we ask that each Ad management client consider this a 4 month marketing plan to allow the marketing to work to its fullest capacity. Any questions about ad management and working with real estate teams please contact us. here are no refunds or partial refund with the ad management or marketing service.

We are NOT responsible for any legal requirements that pertains to your state, MLS board or brokerage and any marketing material. If you need your License number included on a website or marketing material it is the responsibility of the user, and not postAprop or prophosting, to provide the required license number and marketing requirements. Once an online ad or landing page is published, it is the responsibility of the user (Real Estate Agent, Realtor, Real Estate Broker, or Loan Officer) to review the published material to meet any guidelines, standards, requirements, or laws.

DOMAIN REGISTRATION

If you purchase to register a domain with propHOSTING, postAprop, or BestSqueezePages.com. you MUST agree that you will not transfer the domain to another domain name registrar during the first 60 days after its initial registration date.  All domains require an annual fee for registation and will renew automatically unless you cancel. You will be charged an annual fee the same day any domain is regsitered and renewed.

If you want to transfer your domain you must:

1. Pay all past due invoices.
2. Contact us after the 60 day period has expired and include your full name, email, and the domain name.  Send domain transfer requests to: ssm@nopsites.com.


SUPPORT

  

Our website service comes with our built in "Squeeze Page Software", hosting, email marketing, and a full cpanel.  The cpanel has outside software products installed and offers the user the ability to upload outside website themes and templates.  To setup "squeeze pages" users do not need any website experience.  We ask you simply follow the short "how-to-videos" inside our site.  These videos will show you how to get your pages live and how to edit the pages. We do not offer support on any 3rd party products, software, codes, websites, and templates.  We do not offer phone support.  We do offer email support. SPAM

We DO NOT condone spam which is defined as unsolicited bulk email, often called junk mail. By sending e-mail to only to those who have requested it, you are following accepted guidelines.  Users are not permitted to upload leads or email lists to our system, cpanel, or any websites hosted by our service with written approval.  Users are not permitted to upload any email marketing programs to bulk email.  Users are not allowed to use any email addresses from "Purchase Leads" or from any other source then email addresses that opted in to their squeeze page or websites.

Any user who sends out spam will have their account terminated with or without notice and you will be reported to ANTI-SPAM agencies.  Sending SPAM could result in fines and blacklisting of your IP address. DISCLAIMER

Our company makes no warranties of any kind, expressed or implied for services we provide.  We shall not be responsible for any damages your business may suffer from the use of this website.  This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions. 

 

GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the State of Nevada without regard to its conflict of law provisions. By using this web site, you irrevocably consent to submit to the exclusive jurisdiction of the courts of the State of Nevada.

 

RESTRICTIONS ON USE

This web site is owned and operated by postAprop & propHOSTING. This website and its contents are protected by domestic copyright laws and international treaties, and all rights are reserved. Neither this web site nor any of its content, such as the website templates, may be used outside of our hosting servers without our express written consent. You acknowledge and agree that any downloadable content on this web site is not licensed for you to use outside of the website at propHOSTING.com.  The graphics, logos, website templates remain the sole property and copyright material of propHOSTING. No right, title or interest in such content is conveyed to you.

Upon cancellation of your account for any reason (such as nonpayment) you surrender the right to use any of the content, graphics, and website templates that are provided on our website.  Users may only use this material on our hosted servers. No downloads of templates is allowed.  Using our website templates, files, scripts, logo, images and graphics with any outside hosting service is prohibited.

Users are permitted to download the database from any website.  The database includes information gathered on your websites such as name and email of website visitors.  This information is owned by you.  propHOSTING has no right to use this information for any purpose.  Upon cancellation each database will be deleted and New Outlook Properties will never contact or use any email or contact information gathered on your websites.


REQUIREMENTS

Our service includes a hosting account.  To use our service you must have at least one domain "pointed" to our hosting service. This can be done by registering a domain with us or "updating the nameservers" for any domain you have registered with another company.  Updating nameservers is very easy to do,  After signup, we will send the nameservers to you.  If you are not sure on how to update the nameservers just contact the company that registered the domain.

We may amend this agreement or the contents of the site at any time and at its sole discretion,
